  • Where, geographically, is audio processed?
  • Is audio stored at any point — and if so, for how long?
  • Are sub-processors enumerated in the DPA?
  • Is patient content ever used to train models?

3. On-device processing explained

Modern smartphones ship with high-quality speech recognition built into the operating system: Apple’s Speech framework on iOS and the equivalent on Android. These engines run entirely on the device’s processor — no network is required. AI documentation tools that build on this capability inherit a powerful privacy guarantee: clinical audio never leaves the device.

Architectural impact

Because no clinical content is transmitted, the vendor cannot, as a matter of architecture, see, store, or share the consultation. This collapses the GDPR processor question into a much simpler one: the vendor processes only account-level metadata, not patient data.

Accuracy

On-device engines now reach within 1–2 percentage points of cloud equivalents on standard English healthcare vocabulary. The accuracy gap narrows further with light personalisation and is, in practice, indistinguishable to clinicians for documentation purposes.

4. GDPR compliance checklist

  2. Is the vendor a UK-incorporated entity?
  3. Is a DPA available without bespoke negotiation, and does it cover all sub-processors?
  4. Is there a clear, written commitment never to train on customer data?
  5. Is the audio retention policy zero, with automatic deletion after transcription?
  6. Are transcripts encrypted at rest on the device?
  7. Is there a documented incident response process?
  8. Is there a public DPIA template the practice can adapt?
  9. Does the vendor publish an accessible privacy contact?
  10. Are subject access requests handled within 30 days?

5. Practical guidance for practices

CQC alignment

AI documentation should be incorporated into your existing record-keeping policy, not bolted on. Update written procedures so that inspectors can see how the tool fits the established framework for clinical record creation, retention, and review.

Patient consent

Where the lawful basis is provision of healthcare, explicit per-consultation consent is not generally required, but transparent notice is. Update waiting-room signage and your privacy notice to explain that AI assistance is used to draft notes and that recordings are processed on-device.

Staff training

Train clinicians and reception staff on three fundamentals: when to start and stop recording, how to verify a transcript before saving, and what to do if a recording is started accidentally.

Incident response

Even with on-device tooling, devices can be lost. Mandate device-level encryption (built in to modern iPhones and Android phones), require a passcode of six digits or longer, and document the steps to remotely wipe a lost device.

Conclusion
